Consumer Who Entered Into Debt Settlement Agreement Files Class Action Lawsuit Complaint Against HSBC Card Services Over Alleged Collection Of Past Due Credit Debt.

A class action lawsuit has been filed against HSBC Card Services, Inc. (“HSBC Card Services” or “HSBC” or “Defendant”) in the United States District Court for the District of New Jersey (styled Chastity Bradley v. HSBC Card Services, Inc.), alleging, among other things, that HSBC “accepts all but the remaining few payments from the consumer directly or indirectly through the Debt Settlement Company or law firm and than unilaterally and without cause refuses to accept the remaining payment and instead deems the settlement null and void,” according to the HSBC Card Services class action lawsuit complaint.

The HSBC Card Services class action lawsuit complaint reportedly asserts counts for breach of contract and common law fraud and reportedly seeks to recover actual, statutory, treble, punitive damages, declaratory and equitable relief and reasonable attorneys’ fees and costs .

    Oh did I ever have a bad experience with their debt collectors. He couldn’t even speak English decently, but I understood enough of his rambling to know he called me a white trash hillbilly, a redneck’s wife, and I farted in the phone and hung up. Wish now I had recorded this, I sure missed out on this class action lawsuit. I would have sued their asses off bigtime. No one, but no one ever has the right to talk to you this way even if you do owe money. They do themselves. I heard these debt collectors are people who cannot find a job anywhere else. Anyone else heard this? They are ex-cons.

    I have the same problem with HSBC too. I paid their Collection Agency and the Collection Agency updated their account with all three credit bureau but HSBC refused to do so. I paid the account off because my x-wife had used my informations to obtained the credit card.

    I paid my last payment with HSBC and closed my account. Two months after doing this I revive another bill from HSBC stating that I owe $2 plus a late fee of $29.00. I called and they removed the charge but still reported it to all three credit reporting agency’s. It took years for me to get it removed.

    I have paid my monthly payment 3 weeks early every month, 2 months HSBC applied two payments to 1 month. I now have LATE fees applied to my account…..what I was told is that this is “just how the credit industry has to be” I DO NOT understand how this is legal or ethical. I always pay my debts early and this is so frustrating to me! This is part of what is wrong with America!!!

    We purchased a motorcycle. Hsbc call stated we were $600.00 behind. I made my payments of 69.00 every month. Paid 70.00. They stated to me that the payment was not getting there by the 24th of the month and the payment was not covering the late charges…… But if I would pay 200.00 they would bring mr back to current. I asked if the due date could be moved to the end of the month, i was told yes…again yes. i said ill pay the 200 i did. 3 month later, im again 300 behind. i asked why. they said that payment not there before the 24th. I stated I thought it was fixed, they said the person who said payment was due at end of the month was not authorised to do that. I asked if they would wave the late fees due to being told that it would be due at the end of the month, they said no they already waved them once and will not do it again. i TOLD THEM TO COME GET THE MOTORCYCLE, I WOULD NOT GIVE THEM ANOTHER PENNY.

      Whoops hit enter. they came got the 7,000 dollar bike, sold it for 2000 and now comming after me for the rest. PLEASE ANY HELP WOULD BE GREAT. ICAN SHOW EVERY PAYMENT MADE UNTIL I TOLD THEM TO COME GET IT.
      TO HSBC EVERTHING HERE IS THE TRUTH, SOMEONE WILL HELP. IM SURE THERE ARE THOUSANDS OF OTHERS AND HERE WE COME TO GET OUR MONY BACK, THIS IS FRAUD, HAS TO BE AGAINST THE LAW.

        I ended up with two hsbc credit cards when I bought two seperate motorcycles. Both times I was told manufacturer financing. Didn’t need to go through the bank I used previously. Some time later I get a hsbc credit card. % rate was never what I agreed to and is clearly printed on contract. I quit paying them and they sold the account to CACH for pennies on the dollar. Ask hsbc for the 6 billion in tarp money they got and see what they say. I think everyone should refuse to pay all their credit cards regardless of who issued them and put and end to this endentured slavery, resulting from Ronald Reagan’s deregulation of banking in the 1980s. It’s the same thing the IMF and World Bank do to “developing nations” to enslave them. Come on people, make Ghandi proud with your nonviolent noncooperation.

    they are the rudest people i have ever heard from i am hard of hearing and when they call me it is hard to understand where i am hard of hearing and i ask them to speak up they start talking lower where i cant hear them you know what they are saying and i tell them that i am on a fixed income and they say how did you get a credit card i told them that i filled out a application and they sent me one i wish to god that i had never fill out a application

    Hsbc is the worst, they add amount $35.00 when you’re just a few days and they tell I been late since last december 2011, sometimes I pay more than twice a month, but I still owe them. I only bought a kenmore freezer from Sears that don’t work anymore, warranty no longer on it, but my bill does not decrease due to their late fees. I’m so over it now I just want to pay this bill off and cut up the card with quickness.

    Why have I not seen the theory of “contract of adhesion” argued in these lawsuits against HSBC ? If a court of equity determines that a term of contract written by the party with overwhelming advantage over the other party is unconscionable, then the court may rule that term/s as unenforceable. Seems to me that one lawsuit against HSBC addressing each and every questionable term of contract would settle all of these issues, rather than suing over them one-at-a-time. Each individual contract term lawsuit opens the door for addressing the aforementioned comprehensive contract examination at issue. Then the court could appoint an administrator to oversee HSBC contracts, thereafter, in that HSBC would probably revert to type after a few years “coolng off” period for consumers.

    not sure what to think i have been getting bills with a minimum due of 1800$ ,have been receiving daily collection calls i have sent a payment of 500$ which was accepted by hsbc yet i still get collection phone calls if there is a class action lawsuit aainst this company i want in.

    I never had an HSBC credit card but a Neiman Marcus card. When the market crashed in 2008 so did my world. I was a recruiter in the financial sector and my placements went unpaid by Lehman’s and others. About 8 months worth of commissions went unpaid. I defaulted on all my credit cards. Hard lesson learned.

    Fast forward to 2012 and I opened an HSBC saving account. I had no idea HSBC were the underwriters for Neiman Marcus. What did HSBC do? They gave my phone number to 4 Star Resolutions (debt collector) and had them harass me about the money from 2008. I called Neiman’s to make certain this was their debt and they explained it was HSBC’s AND the amount owed was $1500.; not the $3500. the debt collector was trying to get. UNBELIEVABLE.

    Incidentally, hell will freeze over before I will give them ONE CENT. Or to put it in simple terms, the banks owe me money on the interest I lent them as a tax payer. When they pay me back then we can have a discussion. Until then I will refer to the California stature of four years on credit card debt.

    I agree with everyoneof these complaints. PLEASE, nobody ever deal with HSBC/Beneficial. They are an eating Cancer of money. I paid them over and above payments on a 10,000 loan and after 5 years, they still claimed I owed them 9600. My husband took out a second mortgage on our home just to pay them out. I think this was nothing but highway robbery. I wrote: NC atty General, Governor, Comm.of Loans, Federal Trade Commission, and about 4 more(all that kinkos bill) Then, I was told I needed a lawyer(how was I going to pay for him/her?) PLEASE HELP/REIMBURSE!!!!!!!!!

    I agree with everyone they have used deceptive practices to tack on late fees, this is the lowest. they locked my account so that i could not pay on line and refused to take may payment by phone causing my payment to be late. I would definitely stand with anyone who will sue this company…
