A class action lawsuit has been filed against Eastman Kodak Company (“Eastman Kodak” or “Kodak” or “Defendant”) in the Superior Court of the State of California County of Orange (styled Daniela Apostol v. Eastman Kodak Company, Class Action Case No. 30-2011-00510342-CU-FR-CXC) alleging, among other things, that Eastman Kodak failed to disclose to consumers that its All-In-One inkjet printers use significant amounts of color ink even when the consumer prints black text or black and white graphics, according to the Eastman Kodak All-In-One Color Inkjet Printer class action lawsuit complaint.

The Eastman Kodak All-In-One Color Inkjet Printer class action lawsuit complaint is reportedly brought on behalf of a putative class consisting of the following persons, unless otherwise excluded:

All persons and entities located in the United States who own a Kodak color inkjet printer and who have printed black text and/or images using that printer.

The Eastman Kodak All-In-One Color Inkjet Printer class action lawsuit complaint reportedly asserts claims for alleged violations of the consumers legal remedy act, unfair competition law, false advertising law, unjust enrichment, fraudulent concealment  and equitable estoppel.

    We print mostly plain text and we change cartridges for color just as much for black

    I own a KodakAIO printer,fax and scan. I purchaced mostly becauce of the lower cost of the ink cartirges, and they are.

    Almost all of my print is black and white. I very seldom print pictures or things in color.There is no reason to print them in color, as they are information materials.

    It is ridiculous to use the color cartridge!! They are more expensive and not needed. It is a big waste of money.

    How do I get my name on the lawsuit? I’ve spent far too much on color cartridges, when I only print in black and white (mailing labels in draft mode), and now have to replace yet ANOTHER color cartridge!

    This is a worthwhile lawsuit, for sure!

    I agree. I’ve had Four Kodak AIO printers (5300, ESP 7 (two) , and 2170) – all of which consumed ink much faster than I ever expected. I’ve never even printed a single photo with any of the printers. Went through 5 printhead replacements, 14 ink cartridges and printed less than 500 sheets with my first three Kodak AIO printers – finally they refused to replace. I bought my fourth AIO printer a 2170 and within the first week – it failed and Kodak had to replace it. It’s been working okay for about two months now. Hopefully it will do better than the other 4. Still ink usage is ridiculous – because if you don’t use every day – and you do a clean cycle – it really consumes the ink. I don’t buy all the hype about saving ink with the Kodak AIO printers.

    The cartridges have a small chip on them. From what I’ve read they basically allow a predetermined number of minutes of printing. I suspect these color cartridges are “timing out” while printing black and are reported as empty when little or no ink has been used. I may be wrong but I don’t know where the color ink would be going.
    I cut my losses and threw mine away, what a waste. Kodak has made my black list.

    I HAVE THE ALL IN ONE KODAK & I AM VERY VERY HAPPY WITH IT. IT DOES A GREAT JOB & I SAY IF YOU ARE SO TIGHT YOU DON,T WANT TO BUY THE INK(WHICH IS CHEAPER) DON,T PRINT! IF YOU ARE THAT TIGHT YOU NEED TO GO TO YOUR LOCAL GARAGE & GET A LUBE JOB! MAYBE THEN YOU WON,T SQUEAK WHEN YOU WALK!!!

    I agree i had a problem with my printhead did the maintence calibration cleaning and everything they asked had to run get more cartages go thru the same crap and then buy the cartages again only for them to try and run it out again. then they want me to buy a printhead seems it needs replacing every 5 cartages.
    80.00 in 2 days is way to much and you don’t get as many pages printed as they say. Yes I have the settings to black only ! Still usese up the colored ink too, Oh and while doing the maintainence and calibrations and such it didnt even put ink on the paper so where did it go???? I want in on this lawsuit as the only reason i bought this one was because of the ads saying how cheep the ink was, well they didnt tell you that the color cartage cost! They stated the ink for the printer was under 10.00 am i tight with my money ?? You bet i am and do I squeek when I walk yesss! I try to pay for quality and expect it to do as claimed, when it doesn’t then I get upset. car, clothes, computer, computer, TV, Phone doesn’t matter if it doesnt work right or isnt what I was told it was going to be or cost then its false advertising!

      OH by the way you cannot have just one cartridge in there the printer will not work. It will tell you YOU MUST replace the colored cartridge.

    I bought this printer because of its capabilities (ESP 5250 all in one). I started having problems about 5 months after purchase. I didn’t stand for the India customer service so I started dropping hammers in the U.S. calling the factories and ended up with a lady in New York. To her credit she sent a new print head and a color and a black ink. I also keep up on the firmware. This took car of things for about another 4 months. Now, I get about 20 pages before the black runs out. It fades and is just terrible. The color ink goes even if I don’t use it. I think 20 pages of black ink page printing is unsatisfactory to say the least. I paid around $170 for this at Best Buy and feel cheated.

    I would love to be a part of this lawsuit if out of state people can participate. I sell from e-bay and print (or try to print) shipping labels from Paypal. Just this very night I had an item put on hold to ship until I can get ink and print a shipping label that will scan. This can cause big trouble and cost me money.

    I too have the same problem; and my Kodak printer is still under waranty. As soon as the color ink steals away in the dark to make way for a new cartridge, it’s going to get lonsome. I’m takeing the printer back to Walmarts. And does anyone out there know where the color
    ink goes? Does it fade in to the black ink?

    Earliest design of Kodak cartridge holder was changed to allow B/W printing from single B/W cartridge when Color cartridge is low.
    However basic problem with printer, excessive ink usage, has not changed…Even while printer is not in use the ink from both cartridges slowly dries out (evaporates) because of the poor seal design between the cartridge orifices and cartridge holder. (Separating the cartridge and holder is key to Kodak reducing ink cartridge costs)
    The evaporating ink leaves a dried powder pigment in the orifice which gradually builds up and then blocks the ink flow completely…requiring replacement of the cartridge holder.
    I have two of these printers and over two years have replaced two holders and numerous cartridges to figure out where the problem originates…with a lot of wasted and money.

      I just bought my Hero 7.1 2 months ago and it does not print in black when it said the color is out. By the way, the ink level for the color cartridge is reported by the monitoring program to still have 35% color ink left in the cartridge.

    kodak also uses “smart chips” in ink cartridges which use ROM memory to store serial numbers as being used and empty. you can’t refill a cartridge for reuse without buying a compatable chip. this process of “smart chipping” ensures that consumers can only buy ink from one manufacturer thus limitting the consumers choice and monopolizing a portion of the market. also, the cartridge is programmed to pass only a certain number of times over paper, and is deemed to be empty when fluid actually remains inside so you are forced to replace more often wasting money and resources. if you remove a cartridge with a low warning to shake it the sensor reads empty when you replace it in its slot even though there is ink in it. smart chips are illegal in europe as they should be everywhere.

    I purchased a 30 XL color cartridge today. I needed to print 400 pictures. It only printed approximately 220. The statement in the corner of the package had 550 pages. If I would have known that I was going to need to spend 70 dollars for two inks and 36 for 4 photo paper; I would have decided to take them to a retail location and spent 60.00 for everything. I’m so upset with this right now. I don’t think they will take the empty cartridge back now. But, it did NOT print 550 like it stated! Considering my newly discovered shortage of ink; its too late now to take back the printer which I purchased six months ago. BLAHHHHHHHH!

      I’ve read a post on another site that Kodak’s claims for the number of print jobs per cartridge are based on print jobs which consisted of 1/3 paper length. I have a ESP5210 and I’ve never gotten the amount of print jobs claimed per cartridge. I think this is one of the deceptive tactics they used to lure people into purchasing their product.

    kodak, major scam with this printer. i purchase ink all the time, and now i cannot print anything that is black. so, i have to go down the street if i want to print something black and white. absolutely ridiculous run around. i would love to be part of this lawsuit. does anyone have any info? i am certain the lawyers would love to have as many customers as possible.

    Pretty good site, but I was hoping to find out how I could be listed in the class-action suit against Kodak. Nobody has posted that info here, and there are no links to any results of the lawsuit, so using this site has been a waste of my time.

As we read that, it could just as easily be phrased as anyone who has printed from a Kodak printer, because it is unlikely anyone who owns a color inkjet model hasn�t printed at least one or two pages in black and white.

    In their defense, Kodak is not the only OEM inkjet manufacturer who has dealt with these suits. HP had a similar situation arise in 2010 which it settled by offering the members of the class e-credit towards the purchase of ink or a new printer. Epson also dealt with a class action which was begun in 2009.”

    Even more than this is the fact that Kodak software has built in software rendering the printer unusable without connecting to a network and obtaining constant updates – I found out right away that if I’m out of ink (because I ran out of color ink even though I’d printed nothing in color) – I had black ink left however it forces you to go online and purchase more when it is low – it will not allow you to use the remainder of the ink. People may be sending important documents via a scanner – I almost lost the home I was purchasing and was up for an entire night trying to scan through a purchase and sale agreement due first thing in the AM but the scanner again would not work – just kept bringing me online and the software would no longer work. This is even worse than the ink problem as it could severely ruin someone’s life.

    This policy is a low for Kodak, who I have great respect for during my days in photography. I have a Kodak printer, and while cartridge prices are reasonable, and unlike a more highly touted name brand, I have not had to reinstall the printer (HP), the policy of making consumers replace color carts when B&W printing is wanted, is just greed. The software is deliberately designed to keep one from printing simple documents when color ink is low. While I won’t be taking the drastic action I’ve heard from others (target practice on the printer), if it stops working, it’ll be the last Kodak printer. Canon or Epson, perhaps. Low ink cartridge prices are not enough, Kodak!

    I wrote to Kodak, who left the impression that the problem was me. As a shareholder of Kodak, I wrote to Investor Relations. They failed to respond.

    I just read these comments and now know why my ink costs were not as cheap as Kodak advertised. I was forced to seek alternate ink supplies such as from Clickinks.com in order to afford printing. I also now need to advise all Kodak printer users to NOT update their software from Kodak. I did so this morning and found that afterward, my ESP7 printer would no longer work. It gave me a “Color ink cartridge not recognized” error. I chatted with Kodak, via India, and found that their only response was “Kodak recommends using only Kodak inks” which was religiously repeated at least a dozen times in “answer to my question “why does Kodak totally disable their printers when a second source ink is used?”. I could not even connect to the printer to scan or anything. The upgrade totally disables all printer access until you buy a “Kodak” ink cartridge. The words “monopoly” and “captive customer” come to mind. Prior to the upgrade, I had no problem with second source inks. The partial solution was to reinstall the original disk software in order to get it to operate. This resulted in not being able to have the software features that I had previously received from a prior upgrade. So my printer usage has been greatly diminished. So I am no longer a Kodak customer in any sense of the word…more of a casualty to their new policy that treats customers as property. I hope that Kodak does not try to resurrect itself…it has become an embarrassment and a shame to the founders name. Kodak was a credible company once and I have a lot of fond memories of my darkroom where I used many Kodak products. How sad.

    I also rarely print in color having set both the printer and the properties to print b/w and still I need to run out and buy color ink. Why? Where is it going?
    Another question…. If I am out of color ink and only want to print in B/W why won’t my printer print? It really frosts my cookies when I have to run out to Wally World to print one last page because the printer says I am out of color ink which I was not using in the first place! At least give me the option.

    I would like to know how to get on the list as well, I loved the “all in one” until I discovered it’s hunger for ink cartridges. I thought I was going to save money on ink but no it devours them! I should have kept my old HP. And yes they have some kind of downcounter because you can be printing perfectly fine then the next sheet stops and says empty, not good when the kids have a report to hand in the next day!

    I purchased a 5 in one Kodak a couple of years ago and I did so mainly to save on the Ink as it was advertised on the Apprentice!! Not only didn’t I save, it has cost me a fortune in INK. First of all their ink cartridges don’t last that long and secondly when you try to use a cheaper brand, after a day or two, maybe 10 copies, it says you need to replace the ink cartridge. What a rip off. Now, my printer is printing so slow, it is ridiculous!!

    I’ve had my Kodak ESP7250 for 2 years. Thank goodness I’ve not had to do an enormous amount of printing. I remember all those info-mercials they had on tv a few years back. They made it seem like the best printer on the market. I have run out of ink while preparing taxes, while trying to print much needed medical Rx prescription coupons, basically every important job I need to do, there this thing is saying I need to replace an ink cartridge. I have resorted to just writing down driving directions and such. Now, customer service tells me my printer is bad, (it goes through the motions, but spits out blank pages).
    They say I can buy a reconditioned model for 60-80 dollars, but I have to buy the printhead separately, as well as the ink cartridges. I said “ugh and no thanks”. I will have to resort to a different brand of printer since now I know about the lawsuit over the color cartridge supplementing the black print. What Houdini’s they are. Who would have guessed that one???

    I buy a brand new Kodak All-in-one Printer for Christmas in 2012. never take the printer box. still until June 2012 and stop working July 2012. I buy this printer from Wal-Mart Store and lose the receipt, I pay cash for the Printer and can not get fixed. I feel any store that sale any Kodak printer should by take off the shelf and not sale at all. I am just find out that so many peoples are get rip off. it make me so angry.

    I have a Kodak ESP Office 6150 All-In-One Printer and was constantly replacing the “inexpensive” cartridges. Not so inexpensive when you’re having to replace them constantly. Now, apparently, the print head has failed and because it’s past the warranty period I’m responsible for the cost of replacing that. This printer is barely used, so I certainly don’t understand how the print head would have gone bad already! I imagine the printer is probably as poor quality as the cameras I have that eat up the batteries within less than a week of being installed in them. I really believed that Kodak was a name I could trust. I’m so disgusted with all the junk that they sell now, I would never, ever purchase another thing with the Kodak name on it. And I’m making it my personal mission to make sure that everyone I come in contact with knows about the garbage that they’re selling to consumers!!

When someone says you can print 425 black & white pages and 420 color pages I expect it to be close, NOT 50 OF EACH! Do the math, that’s not even a quarter of what they claim.     I cannot understand why people are complaining about the cost of ink/cartridges with Kodak Printers. We have 10 of them (various models) and agreed you have to buy a new print head every so often but compared with our HP/Cannon/Epson printers they are substantial cheaper on ink/cartridge cost so why not attack these other firms, whatever their system does or does not do the Kodak system works out much cheaper. If you cause Kodak to withdraw from Ink supplies you will end up having to buy new printers and more expensive ink!

    Mosly used to copie black & white..was baffled when i needed to replace the ink, that i needed color also!! When there was no need to replace the color one!
    What a rip off this printer is!

    I bought a Kodak printer thinking it would save money on ink as advertised. It was after the color ink cartridge ran out that we discovered you needed to replace both to be able to print again. This equated to an expense of approximately $25 more on ink every month when compared to Canon. Kodak said this was to “ensure quality printing”. I say it is a textbook example of bait-and-switch.

    I bought new ink cartridges combo pack black and color , for my kodak esp 6100 series 1 week ago the ink was bad . Contacted Kodak they claimed printhead I keep telling them it was ink bad package well week later replaced printhead same issue bad ink tehy said the would send out black but not color and another week to wait both color and ink is bad. It doent matter the things eats the ink but top it off there saleing bad packages og ink and what even honor that I will never buy another kodak printer or ink stay away from them the company wants your money and return gives you damaged products for your money out $34,00 for ink and not counting the printer and expense to buy a new one
