Comcast Cable Subscribers Win Class Certification Ruling On Appeal In Class Action Lawsuit Against Comcast.

The United States Court of Appeals For The Third Circuit has affirmed a district court’s certification of a class in a class action lawsuit filed against Comcast Corp. (“Comcast” or “Defendant”) in the United States District Court for the Eastern District of Pennsylvania (styled Behrend v. Comcast Corp.), alleging, among other things, that Comcast overcharged customers for cable service after it acquired cable providers in Philadelphia, purportedly in violation of sections 1 and 2 of the Sherman Act, according to a Comcast Cable Antitrust class action lawsuit news report.

The Third Circuit in the Comcast Cable Antitrust class action lawsuit appeal reportedly held that the district court did not exceed its discretion in determining that Plaintiffs established by the preponderance of the evidence that they could prove through common evidence class-wide antitrust impact via alleged higher cost on non-basic cable programming and a common methodology to quantify damages on a class wide basis.

    I had comcast for over five years and my bill went up every year and most of those years I only had premium basis and I was paying over a hundred dollars a month. I think my share should be a thousand dollars

    I dropped Comcast in 2008 because they keep raising their price and was down more then up. I am wondering if I am able to be part of this class against suite. Please contact me via email to let me know. I would not go back to Comcast if they said they would give me a million dollars for life. They are one of the most crocked companies in the world.

    It’s high time this Oppressor of the Masses [Comcast] was taken to task for their malfeasance. Someone should go after them for wining and dining that wholly owned subsidiary of corporate America – the Republican Party.
    Back when they dominated the House of Representatives with that pseudo Democrat puppet of corporate America, President Clinton, the House passed and Clinton signed into law, the Telecommunications Act of 1996. Essentially, that deregulated the cable industry nationwide, taking away from the states the power to interfere with spiraling costs in return for the promise of fiber optics and more competition in the future.
    During the summer of 2000, the GOP held their national convention in Philadelphia. There was a huge banner where that event occurred with the following ” Comcast – Proud Sponsor of the Republican National Convention”. The very next month, my cable bill [along with everyone elses] was increased. No doubt in my mind – so Comcast could recoup the $60 -80 million dollars it cost them to underwrite and pay for the convention. Comcast is despicable.

    How about a class action suit for Comcast not delivering on their promises. I had my service installed on March 27,2011 and was guaranteed a prepaid gift card – well after 20 phone calls and chat sessions I still have no gift card and they just sent me an agreement on Dec. 9th and according to that I have been billed $30 per month to much since my service was installed. I was guaranteed that someone would call me back on Monday Jan 9th to resolve the issue but it here is Tuesday night and still no call back. Comcast = No Customer Service and No Guarantee.

    In my experience Comcast is in violation of at least 4 FCC regulations and have been overcharging customers who use cable cards versus the comcast provided cable boxes. In my experience the overcharges are in the neighborhood of $10-$15 a month. I am sure there are others also affected – I think it would be great if someone picked up a lawsuit against Comcast for their gross negligence in this arena.
